If you are considering hiring a housemaid in Dubai to look after your baby. It is important to understand the latest rules and regulations surrounding this process. This guide will provide you with a comprehensive overview of the requirements and steps involved in recruiting a nanny in the UAE, whether you choose to hire locally or bring one from your home country. By following these guidelines, you can ensure a smooth and compliant hiring process.

Understand the Applicable Laws

In the UAE, the Federal Decree Law No. 9 of 2022 Concerning Domestic Workers and Cabinet Resolution No. 106 of 2022 govern the employment of domestic workers, including housemaids. Familiarize yourself with these regulations to ensure compliance throughout the hiring process.

Eligibility

To sponsor a nanny as a resident in Dubai. You need to meet certain eligibility criteria. These include being employed in the UAE and considering the size of your accommodation and your salary.

Required Documents

Before hiring a nanny, you wil need to gather specific documents for both the nanny and yourself as the sponsor. The necessary documents typically include:

Documents of Nanny

  • Color photo of the nanny
  • Nanny’s passport
  • Nanny’s tourist visa (if in the UAE) or UAE visa cancellation document
  • No Objection Certificate (NOC) from the embassy (if the nanny shares the sponsor’s nationality)

Documents of Sponsor

  • Sponsor’s passport
  • Salary certificate (in Arabic)
  • Copy of the employment contract
  • Copy of Ejari (Dubai residency proof)
  • Copy of legalized and attested marriage certificate (translated to Arabic)
  • IBAN number and three months’ bank statement
  • Original UAE resident ID card copy
  • Copy of the spouse’s passport and UAE residency visa

Obtain an Entry Permit

After gathering the required documents, you must apply for an entry permit for the nanny from the General Directorate of Residency and Foreigners Affairs (GDRFA) in Dubai. Once approved, you can proceed with the employment process.

Sign the Employment Contract

Both the sponsor and the nanny must sign an employment contract with the Ministry of Human Resources & Emiratisation (MoHRE) to formalize the employment arrangement.

Medical Fitness Test and Resident ID Card

Following the contract signing, the nanny needs to undergo a medical fitness test conducted by the Dubai Health Authority. Additionally, she should apply for a UAE resident ID card through the Federal Authority for Identity, Citizenship, Customs & Port Security.

Comply with Employer Obligations

As an employer, you are obligated to provide certain facilities and conditions for the nanny. This includes appropriate accommodation, provisions for food and means, timely payment of remuneration, health insurance coverage, and respect for the nanny’s rights. Make sure to adhere to these obligations as outlined in the UAE Domestic Workers Law.

Work Hours and Rest

According to the Cabinet Resolution 106 of 2022 on Domestic Workers Law, employers are required to limit a nanny’s working hours to a maximum of 12 hours per day, with a break after eight continuous hours. Additionally, you must grant a weekly day off for the nanny.

Consider Recruitment Agencies

 While you can hire a nanny directly, you may also choose to engage the services of recognized domestic recruitment agencies in the UAE. These agencies can assist in finding suitable candidates and streamline the hiring process.
